Lodging accommodations are taxed at the 4 percent state sales tax rate, plus city tax rate and a 1 percent tourism tax. For both state and city tax, the room is exempt from tax if rented for 28 consecutive days.
A refund on sales, use and contractors excises taxes for projects filmed in South Dakota exceeding two hundred fifty thousand dollars in taxable costs. The refund shall be one hundred percent of the taxes attributed to the taxable project costs in excess of two hundred fifty thousand dollars. The refund of taxes for a production pertains only to project costs incurred and paid after July 1, 2006, and within thirty-six months of the approval of the application required by the South Dakota Department of Revenue.

South Dakota has four different seasons, each with its own special look and feel. Temperatures can be high in the summer and moderate to low in the winter with low snowfall in most instances. The high country of the Black Hills can receive 15 feet of snow during the winter. Skies are generally clear with excellent visibility.
13. What are the child labor laws in your area?
Maximum hours for children under sixteen–Exceptions–Misdemeanor. No unemancipated child under sixteen years of age may be employed for more than four hours in any school day, twenty hours in any school week, eight hours in any nonschool day, forty hours in any nonschool week, or after 10 p.m. in any day that precedes a school day. The provisions of this section do not apply to children employed as actors or performers in motion pictures, theatrical, radio, or television productions. The provisions of this section do not apply to roguing or detasselling of hybrid seedcorn for any nonschool day or nonschool week. The employment of a child in violation of this section is a Class 2 misdemeanor.
Child under fourteen years of age–Prohibited employment–Mercantile establishment, hours of employment–Misdemeanor. No child under fourteen years of age shall be employed at any time in any factory or workshop or about any mine, nor be employed in any mercantile establishment except during hours when public schools are not in session and in no case after seven o’clock p.m. Violation of this section is a Class 2 misdemeanor.

The rich South Dakota culture has been a draw to filmmakers for decades. Films such as Thunderheart, Lakota Woman, Hidalgo and Skins all filmed here and explored the culture differently. Filmmakers chose South Dakota because of the rich culture that still exists here and because of the fascination with the culture and the intriguing history.
The Film Office continuously works to promote South Dakota to filmmakers. We work with people across the state interested in this industry in order to promote the quality workers here. The South Dakota Film Office caters to independent filmmakers, documentary productions and historical portrayals. We also promote to larger productions and are taking steps to make the state even more film-friendly through implementation of recently approved tax incentives.
