Bill Thompson, who has helmed the Georgia Film, Music & Digital Entertainment Commission for the past five years, has resigned. Lee Thomas is now Director of Film, and Greg Torre, who headed the Commission before Thompson, has been named Interim Division Director.

The Georgia Department of Revenue issued revised rules regarding the definition of a “Georgia vendor” for purposes of the tax credit for film, video, and digital production. We have received written confirmation from the Department of Revenue that those revisions will NOT be retroactive, but will apply prospectively from January 7, 2010.
GEORGIA has tightened up the regulations regarding production (buying) service companies. Effective January 7, 2010, out-of-state purchases will only qualify if obtained from a local vendor who rents or sells like items. Thus, a camera dealer can order camera equipment from California if he does not have it in stock, but props or wardrobe would not qualify unless ordered by a company that rents or sells props or wardrobe. Goods ordered from companies in the business of purchasing from out-of-state, that do not operate a rental or sales business, and do not maintain an inventory, will no longer qualify for the film tax credits.

GEORGIA – For the fiscal year ending June 30, 2009 direct production expenditures totaled $591 million and the state estimates the economic impact to be over $1 billion dollars. Twenty-six feature films, 93 television episodes, one-offs, and TV movies and specials were produced along with 250 commercials, 36 music videos and 41 video games. Georgia estimated production expenditure exceeds $350 million from July 1 to December 31, 2009. One of the largest GA film tax credits administered by The Incentives Office was for Robert Redford’s “The Conspirator,” which was filmed in Savannah.

GEORGIA has been generating substantial production interest in its new program which offers a tax credit of up to 30%. However, the credits are subject to recapture, which might present a problem for some potential buyers.

Georgia now offers 30% incentives. The transferable credit is 20% of qualified spend, plus an additional 10% tax credit on qualified spend for inclusion of a Georgia animated logo in a prominent position during opening titles or end credit roll. The Georgia incentive has a $500K hire cap, but no caps for the state program or per show.
