The bill was quickly enacted and signed by the Governor this month. The Kentucky film incentive now has an annual cap of $5 million for fiscal year 2011, and $7.5 million for fiscal year 2012.

The regular legislative session ended without passing HB 530, capping the film tax credit. The Governor has called a special session to begin on May 24, 2010, to resolve the budget issue. The Film Office has been assured that the film industry credits will not be taken up in the budget and that they will remain intact as passed last year.

Legislation (HB530 and HB290) has been introduced to implement a budget for 2010-2012. HB530 declares a fiscal emergency and proposes to cap the film industry tax credit at $5 million during the fiscal year 2010-2011, with a cap of $7.5 million during the 2011-2012 fiscal year. A Senate amendment would make the credit non-refundable. HB530 will likely be rolled into the budget bill.
